General Gotovina respectfully requests the Trial Chamber to strike appendices 11 through 18 of the Prosecution’s Response Opposing Gotovina’s Motion for Provisional Release (“Prosecution Response”). The Prosecutor offers no admissible evidence to support her allegations that Gotovina “twice failed to stand trial in France or to serve his sentence imposed in absentia,” or that “Gotovina received protection and assistance from 100 to 200 armed former military personnel in Croatia as well as from acquaintances and friends in South America and from members of the Italian mafia.” Because the Prosecution has failed to attach a single affidavit in support of these assertions, Appendices 11 through 18 must be stricken.
